Increase your odds of success by doing a comprehensive legal search to determine if your desired name or logo is available!
The first step in applying for a trademark is making sure your desired mark isn’t already being used by someone else. If your application is rejected because your name or logo is already taken, the U.S. Patent & Trademark Office (“USPTO”) will not refund your $250+ application fee! Take that $250 and invest in a Trademark Clearance Search instead. Our experienced trademark attorneys will do a comprehensive search and review our findings with you to increase your odds of successfully securing your mark.
Your Trademark Search includes the following:

A trademark is a design, symbol, word or phrase that identifies the source of your products and distinguishes them from the products of other companies.
The word “Coca-Cola” is a trademark, as are “Coca-Cola” written in stylized script and the original curvy Coca-Cola bottle design.
You can trademark many of the things that you use to distinguish your business from other businesses.
You might have a trademark for:
The scary truth is, if you haven’t trademarked your brand, you don’t own it. The sooner you trademark your name, logo, and other branding elements, the sooner you lock down ownership so they can’t be used by copycats.
We accept PayPal. And if you have PayPal Credit, you can pay over 6 months with no interest!
We will perform your clearance search and be ready to discuss the results within 5 business days of purchase. This is Step 1 in the process.
Step 2 is the actual Trademark Application. If our research indicates you have a good chance of securing your desired mark, you will have the option of purchasing our Trademark Application Package.
Please note that although the Clearance Search can be done in a few days, the actual application process with the U.S. Patent & Trademark Office (“USPTO”) can take several months to a year. It all depends on how fast the USPTO is working, and if more information is needed.
Yes! The Trademark Clearance Search is available to businesses in all 50 states. Trademarks are issued by the U.S. Patent & Trademark Office (“USPTO”), which is a federal agency. It is not state specific, so we can do the search for business owners in any state.
Registering your name as a trademark is a separate process from registering your logo. It requires two separate clearance searches and applications with the USPTO. Please purchase one Trademark Clearance Search Package for each name and logo you wish to search.
If, after our search, we determine your odds of successfully obtaining your desired mark are good, we will consult with you to determine if you would like to submit an application to the U.S. Patent & Trademark Office. We can do this on your behalf for a separate fee; please see our flat fee Trademark Registration Package.
It is important to note that there is no guarantee the U.S. Patent & Trademark Office (“USPTO”) will approve your application, even if the results of our search indicate your odds of success are good. Even if our search indicates your odds of approval are good, we make no guarantees that the USPTO will grant your application.
If our search results indicate your desired name or logo is already taken, or there is another mark very similar to yours that may cause your application to be rejected, we’ll discuss your options. This may include modifying your mark slightly to increase your odds of success.
Yes, but it is not recommended.
The process of registering a name or logo for a trademark with the U.S. Patent & Trademark Office (“USPTO”) is a multi-step process. The first step is doing a comprehensive search to make sure your desired mark isn’t already taken. There is no point in applying if you have no idea if your mark is even available. If you don’t do this search, and your application is rejected because your mark isn’t available, you will be out both time and the $250+ non-refundable application fees.
There are no guarantees your application will be approved by the USPTO, even if our search indicates your odds of success are good. Because of this uncertainty, it’s wise to do as much research as possible before applying to increase your odds of success. That’s what the Trademark Clearance Search is for.
