Yes! The Trademark Clearance Search is available to businesses in all 50 states. Trademarks are issued by the U.S. Patent & Trademark Office (“USPTO”), which is a federal agency. It is not state specific, so we can do the search for business owners in any state.
Registering your name as a trademark is a separate process from registering your logo. It requires two separate clearance searches and applications with the USPTO. Please purchase one Trademark Clearance Search Package for each name and logo you wish to search.
If, after our search, we determine your odds of successfully obtaining your desired mark are good, we will consult with you to determine if you would like to submit an application to the U.S. Patent & Trademark Office. We can do this on your behalf for a separate fee; please see our flat fee Trademark Registration Package.
It is important to note that there is no guarantee the U.S. Patent & Trademark Office (“USPTO”) will approve your application, even if the results of our search indicate your odds of success are good. Even if our search indicates your odds of approval are good, we make no guarantees that the USPTO will grant your application.
If our search results indicate your desired name or logo is already taken, or there is another mark very similar to yours that may cause your application to be rejected, we’ll discuss your options. This may include modifying your mark slightly to increase your odds of success.
